Ryan Zehl and Bryant Fitts obtain $132,000 Jury Verdict against Kroger
- Ryan Zehl and Bryant Fitts recovered $132,000 from a jury in Fort Bend County on behalf of their client, Cathy Guillory, on May 26, 2010. Mrs. Guillory injured her knee and had to have arthroscopic surgery after the check out table came lose while she was buying groceries at the Kroger store on Grand Parkway. Kroger, the defendant in the case, only offered $5,000 to settle the case before trial. Kroger claimed that Mrs. Guillory's knee problems were not related to her injury at the store and that she actually injured her knee in the store's parking lot before she checked out. Ryan Zehl and Bryant Fitts proved that Kroger had known that the check out table had been missing screws for weeks before their client came to the store, and that the table could have been fixed with 2 screws in less than 1 minute. After deliberating for 4 hours, the jury determined that Kroger was negligent for failing to fix the table sooner.

We were able to prove that the barge's captain violated company policy by failing to light the deck and use the spotlights on the bow. Fitts Zehl Obtains a Favorable Settlement on Behalf of Clients who were Injured when Their Vehicle was Hit by a City Bus.
- The bus accident lawyers at Fitts Zehl represented two women who were injured when a bus slammed into the back of their vehicle. Both women injured their backs and necks and, as a result, had to receive over 3 months of physical therapy. The bus driver's company argued that the medical expenses were unnecessary and were not connected to the accident. Our lawyers immediately filed suit for assault and intentional infliction of emotional distress and requested over $1.5 million in damages. The dealership's lawyer claimed, in a motion for summary judgment, that the lawsuit should be dismissed because it was barred by worker's compensation laws and that the dealership was not responsible for the intentional acts of its employees. We demonstrated to the judge that the dealership's motion incorrectly identified the law and settled the case for a confidential amount several days before trial.

- The Jones Act lawyers at Fitts Zehl successfully represented a seamen who injured his knee while working offshore. In addition to challenging liability, the defendant stopped paying maintenance and cure because the Plaintiff failed to disclose previous injuries in his job application. The case settled the day of trial for $375,000.

The defendant argued that the plaintiff was not injured in the accident, was at fault for driving straight in a center turn lane, and that the plaintiff had another accident that required a neck and back surgery after the car accident and before trial.
